Terms and Conditions (T&C) and Consumer Information

Terms and conditions and consumer information within the framework of purchase contracts concluded via the online shop between the online shop - hereinafter referred to as "Seller" - and the customer - hereinafter referred to as "Customer".

  • 1 Scope and General Information

(1) Subject to individual agreements and arrangements that take precedence over these T&C, the following terms and conditions exclusively apply to the business relationship between the Seller and the Customer. Unless otherwise agreed, the inclusion of the Customer's own terms and conditions is expressly rejected.

(2) The Customer is considered a consumer insofar as the purpose of the order cannot be predominantly attributed to their commercial or independent professional activity. On the other hand, an entrepreneur is any natural or legal person or a legal partnership who, upon concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

  • 2 Conclusion of Contract

(1) The contract is concluded with:

(2) The essential characteristics of the goods are as described in the respective product description provided by the Seller.

(3) All offers in the Seller's online shop are non-binding invitations to the Customer to submit a corresponding purchase offer to the Seller. Once the Seller has received the Customer's order, the Customer will first receive a confirmation that the order has been received by the Seller, usually via email (order confirmation). The order confirmation does not yet constitute acceptance of the order. After receiving the Customer’s order, the Seller will review it promptly and inform the Customer within two business days whether the order is accepted (order confirmation). The order process in the Seller's online shop works as follows:

(4) The Customer can select products from the Seller's assortment and collect them in a shopping cart by clicking the button "Add to Cart." By clicking on the button "Cart," the Customer receives an overview of the selected products. By clicking the button "Buy Now," the Customer submits a binding offer to purchase the goods in the shopping cart. Before submitting the order, the Customer can change and review the data at any time by using the browser functions “Back” and “Forward” (represented as arrow keys). The offer can only be submitted and transmitted if the Customer accepts these terms and conditions by clicking the button "Place Order," thereby incorporating them into their order. The Seller then sends the Customer an automatic confirmation of receipt via email, in which the Customer’s order is listed again and which the Customer can print using the "Print" function. The automatic confirmation of receipt merely documents that the Customer’s order has been received by the Seller and does not constitute acceptance of the offer. The contract is only concluded by the Seller's declaration of acceptance, which will be sent via a separate email.

  • 3 Subject of the Contract, Quality, Delivery, Availability of Goods

(1) The subject of the contract is the goods and services specified by the Customer in the order and confirmed in the order or contract confirmation at the final prices listed in the online shop. Errors and omissions are excepted, particularly with regard to the availability of goods.

(2) The characteristics of the ordered goods are derived from the product descriptions in the online shop. Illustrations on the website may not accurately represent the products; colors, in particular, may vary significantly for technical reasons. Images serve merely as illustrative material and may differ from the product. Technical data, weight, dimensions, and performance descriptions are provided as accurately as possible, but deviations may occur within the usual range. The features described here do not represent defects in the products delivered by the Seller.

(3) If, at the time of the Customer's order, no copies of the selected product are available, the Seller will inform the Customer of this in the order confirmation. If the product is permanently unavailable, the Seller will refrain from issuing a declaration of acceptance. In this case, no contract is concluded.

(4) If the product specified by the Customer in the order is temporarily unavailable, the Seller will also inform the Customer of this immediately in the order confirmation.

  • 4 Delivery, Prices, Shipping Costs

(1) Delivery to the shipping company will occur no later than two days after receipt of payment, or in the case of payment by cash on delivery, two days after the order confirmation. The delivery time is up to five days. The Seller will indicate any deviating delivery times on the respective product page.

(1.2) Please note any delivery delays (shipping conditions). The current delivery time is 2-3 weeks.

(2) Delivery is available worldwide.

(3) All product prices include statutory value-added tax. The prices stated are final retail prices plus shipping costs. The Customer will receive an invoice showing the value-added tax.

  • 5 Payment

Payment is made in advance (PayPal, bank transfer, credit card) or cash on delivery.

  • 6 Transport Damages

(1) If goods are delivered with obvious transport damages, the Customer is asked to immediately report these defects to the carrier and to contact the Seller as soon as possible.

(2) Failure to file a complaint or contact the Seller has no consequences for the Customer's statutory warranty rights, but it helps the Seller assert its own claims against the carrier or transport insurance.

  • 7 Warranty for Defects

(1) The Seller is liable for defects in accordance with the applicable statutory provisions.

(2) A guarantee is only provided for the goods delivered by the Seller if it has been expressly stated in the order confirmation for the respective item.

(3) Complaints and warranty claims can be submitted to the address specified in the Seller's identification.

  • 8 Retention of Title

The goods remain the property of the Seller until full payment has been made.

  • 9 Liability

The statutory provisions apply.

  • 10 Contract Text

The contract text is stored in the Seller's internal systems. The Customer can view the terms and conditions at any time in their customer account. The order data and the T&C will be sent to the Customer by email. For security reasons, the order data is no longer accessible via the internet after the order is completed.

  • 11 Final Provisions

(1) The contractual language is German.

(2) For contracts between the Seller and its customers in Switzerland, Swiss law applies, excluding the laws on the international sale of goods. This choice of law applies to consumers only to the extent that the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence is not withdrawn.

(3) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the Customer and the Seller is the Seller's place of business. This also applies if the Customer has no general place of jurisdiction in Switzerland or the EU or if their place of residence or habitual residence is unknown at the time the lawsuit is filed.
